TERMS AND POLICIES

Thank you for joining the Farm Estar movement.  Your use of our Service and mobile application (the “Service”) is governed by this privacy policy (the “Privacy Policy”).  We are pleased to provide this Privacy Policy to inform you of our practices with respect to how we collect and use personally identifiable information in connection with your use of the Service.

INFORMATION WE COLLECT

When you voluntarily provide personal and/or financial information through the Service, we collect personally identifiable information about you, such as your name, phone number, and credit card information.  To facilitate your use of the Service, Farm Estar may automatically collect certain types of information when you access or use the Service. In order to collect this data, Farm Estar may utilize automated tools and files such as “cookies.”  These automated tools and files may reside on our servers or on your computer or device. If you restrict our ability to use automated tools and files, your ability to access and use all or part of the Service may be limited or disabled completely.

The Service is primarily provided through an application on your computer or mobile device. You agree that we may collect and use technical data and related information, including but not limited to, technical information about your device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of product support and other services to you (if any) related to the Service.

FEES

There is no fee for downloading Farm Estar. Farmers/vendors will pay 10% processing fee per sale. Farmers/vendors can choose to subscribe to featured farms with monthly or annual subscription with price to be determined.

FARMER/VENDOR PAYMENTS

All farmer/vendor payments processed by Farm Estar on items sales completed are dispensed to farmer/vendor on every 15th and 30th of the month. Payments can be made through a check mailed to farmers address or ACH direct deposit payment.


USE OF INFORMATION

Farm Estar uses your personally identifiable information primarily to provide you with the Service, to facilitate communication between users, and to provide customized content on the Service that is of interest to you and improve the Service.  We also use such information to facilitate the purchase and sale. The information is also used to verify your authority to access the Service and to contact you when reasonably necessary. Farm Estar may also use any information you have provided as reasonably necessary to administer or provide customer support for the Service, and to provide you with periodic printed or e-mail communications about new services or upcoming events.  You may opt-out of receiving some or all non-Service related communications by updating your profile on the Service. We also use such information for research and analytical purposes, to respond to inquiries, and for other customer service purposes. 

CONTROLLING YOUR PERSONAL INFORMATION

You should be aware that when you voluntarily disclose personally identifiable information (e.g. user name, e-mail address) via forums, postings, profiles or other public areas of the Service, that information, along with any substantive information disclosed in your communication, can be collected, correlated and used by third parties and may result in unsolicited messages from other posters or third parties. Such activities are beyond the control of Farm Estar. Please do not post any personal information on the Service or in other areas that you expect to keep private. You may modify personal information that you have submitted using the Service by accessing the Service and updating your profile information.

DISCLOSURE

Farm Estar will not disclose your personal information to third parties except as provided below.  For this reason you should not disclose information to Farm Estar that you do not want shared with third parties.  In addition to the foregoing, Farm Estar will disclose your personally identifiable information as it believes is reasonably necessary to comply with law, regulation or other governmental authority or to prevent harm to yourself or others.  Farm Estar may also contract with various third parties who help us provide and maintain the Service. For example, we use a third party to process payments made to us. In these cases, we will use commercially reasonable efforts to prevent such third parties from disclosing your personal information, except for the purpose of providing the services in question.  Finally, Farm Estar may disclose your personally identifiable information upon a transfer or sale to another entity of all or substantially all of Farm Estar’s stock or assets in Farm Estar’s line of business to which this Privacy Policy relates or upon any bankruptcy or other corporate reorganization.

LINKS

For your convenience, we may provide links to certain third-party Services or referrals to certain third parties’ products or services.  If you choose to visit a third party’s Service or use its products or services, please be aware that the third party’s privacy policy, and not the Farm Estar Privacy Policy, will govern your activities and any information you disclose while interacting with the third party.

SECURITY

Because any personally identifiable information you submit to Farm Estar is purely voluntary and should not be of a particularly sensitive nature, we employ our standard security measures with respect to this information and do not use special encryption methods at this time.  Farm Estar user accounts are secured by user-created passwords. Please note that Farm Estar cannot guarantee the security of user account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of user information at any time.

It is your responsibility to take appropriate steps to protect against unauthorized access.

COLLECTION OF INFORMATION FROM CHILDREN

We do not knowingly collect personally identifiable information relating to children. In the event that we learn that we have collected personally identifiable information from anyone under 18 years of age without prior parental consent, we will take steps to promptly delete such information. By providing your personal information to Farm Estar, you represent that you are 18 years of age or older.

POLICY CHANGES 

Farm Estar reserves the right to change this Privacy Policy and will post any revisions on our website at http://www.FarmEstar.com/privacy.  We encourage you to review this Privacy Policy regularly for any changes. Your continued use of the Service will be subject to the then-current Privacy Policy.

INTERNATIONAL VISITORS

The Service is hosted in the United States and only US residents may use the Service. If you are visiting our website from the European Union (EU) or other regions, the laws governing data collection differ from U.S. law. Please do not transfer your personal data to us.

NO ERROR-FREE PERFORMANCE 

Farm Estar does not guarantee error-free performance under this Privacy Policy.  We may not always catch an unintended privacy issue, despite our efforts to do so.  Accordingly, we welcome your feedback regarding any privacy concerns that you may have, including how we can improve this Privacy Policy.  We will use reasonable efforts to comply with this Privacy Policy and will take prompt corrective action when we learn of any failure to comply with it.

LEGAL NOTICES

This Privacy Policy is subject to the terms in our Terms of Service, available for review at http://www.farmEstar.com/privacy including terms regarding limitations on damages, disclaimers of warranties, and resolution of disputes.  Our Terms of Service take precedence over any conflicting provision in this Privacy Policy. 

DISPUTE RESOLUTION

These Terms of Service, and all policies and agreements subject to these Terms of Service (including the Privacy Policy) (collectively, “Agreements”), shall be governed by, and construed in accordance with, the laws of the state of Michigan, without giving effect to the conflict of law principles in Michigan. Any adjudicated dispute regarding the interpretation or validity of or otherwise arising out of the Agreements shall be subject to the exclusive jurisdiction of the Michigan state courts in and for Kalamazoo County, Michigan (or, if there is federal jurisdiction, the U.S. District Court for the Western District of Michigan), and the parties agree to submit to the personal and exclusive jurisdiction and venue of these courts. Each party further agrees that any claim arising out of or in connection with the Agreements must be brought within two (2) years of the event giving rise to such claim, whether or not such claim was known or suspected to exist in its favor, and each party hereby waives, releases, and agrees not to sue upon any claim in violation of the preceding. 

LIMITATION ON LIABILITY

NOTWITHSTANDING ANYTHING TO THE CONTRARY, THE LIABILITY OF FARM ESTAR SHALL BE LIMITED TO THE AMOUNT OF COMMISSION RECEIVED BY FARM ESTAR WITH RESPECT TO THE TRANSACTION OR TRANSACTIONS IN DISPUTE. IN NO EVENT WILL FARM ESTAR, ITS AGENTS, OR AFFILIATES BE LIABLE FOR PUNITIVE, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) UNDER ANY THEORY ARISING DIRECTLY OR INDIRECTLY FROM THE USE OF (OR FAILURE TO USE), OR RELIANCE ON, THE SERVICE OR THE GOODS PROVIDED THROUGH THE SERVICE. 

DISCLAIMER OF WARRANTIES

EXCEPT AS PROVIDED IN THE AGREEMENTS, FARM ESTAR MAKES NO WARRANTY, EXPRESS OR IMPLIED, CONCERNING THE SERVICE OR THE GOODS PROVIDED THROUGH THE SERVICE, AND EXPRESSLY DISCLAIMS, TO THE FULLEST EXTENT UNDER APPLICABLE LAW, ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND TITLE. 

ATTORNEY FEES

If any legal action or other proceeding is brought for the enforcement of the Agreements, or because of an alleged dispute, breach, default, or misrepresentation in connection with any provisions of the Agreements, the successful or prevailing party, if any (as determined by the presiding decision-maker), shall be entitled to recover from the non-prevailing party reasonable attorney fees, court costs, and all expenses, even if not taxable as court costs (including, without limitation, all such fees, costs, and expenses incident to appeals), incurred in that action or proceeding, in addition to any other relief to which such party may be entitled.
